What is a marriage contract? Here it is …
You have found the man or woman of your life, the wedding is shortly ahead and a friend opines that for him/ her nothing happens without a marriage contract. It wouldn’t be bad to know what he means by it!
Married couples give them selves certain rules in a marriage contract mainly for the case of divorce. Part of this is e.g. alimonies in case of the divorce, pension arrangement, matrimonial property scheme and the property compensation. The marriage contract can be concluded before or during the matrimony but it is only effective if it is notarilly certified.
The legislator considers the consultation by a notary as a neutral advisor as something indispensable because the marriage contract can contain wide- reaching personal and economical regulations. The notary is obliged to proof every wished agreement of the married couple, of advantages and disadvantages.
It makes sense to inspect the marriage contract from time to time if the content still fits the living conditions.
