The separate property is arranged through the marriage contract. That means that the capital of both partners in the matrimony is totally separated from each other. Therewith both have their own capital and can administer it all by their selves without the agreement of the other partner.

Does the matrimony end both capitals stay separated of course. Therefore it does not matter whether one of the two gained more capital during the matrimony as the other. An equation of the capitals of both partners does not happen.

Have you gained estates together e.g. a house, a freehold flat, television set, furniture or other items of worth it is handled as it is the case with co proprietor.

The part of the married couple who keeps the thing at the divorce has to pay the other partner a financial adjustment, mostly fifty/ fifty. This separate estate is especially suitable for double- earner- matrimonies without children.
